General Terms And Conditions of Lisci Farma Holiday park

General booking terms and conditions for accommodation in Liščí farma Holiday Park are regulated by mutual contractual relations between the operator and individual persons, or possibly legal entities, as service users in compliance with the relevant provisions of the generally binding legal regulations of the Czech Republic, such as the Civil Code, Trade Act – etc. The conditions are binding for all parties involved.

For direct sale of stays (that is to say in cases when the operator requires payment of the full price of accommodation) the following terms and conditions will apply.

Initial Provisions

1. The operator renders its services to all interested parties; persons under 18 years of age may use the services only when accompanied by persons over 18 years of age.

2. The contractual relation between the customer and the operator will be established on the basis of a written order, which is considered to be a duly completed booking form “Accommodation Booking”, sent from the web pages - www.liscifarma.cz, or possibly other completed printed matter, containing all the essentials of a binding order. The customer, who sent the order, will be responsible for the contractual obligations of other persons (co-participating in the stay).

3. When completing the order, it is advisable to state in the note section an alternative time period or different accommodation capacity in case of the required period or the accommodation capacity having already been booked or in case that the operator of the accommodation facility does not confirm the stay for serious reasons.

4. The Holiday Park reserves the right to change the site for camping, or a hotel room (chalet) confirmed in the booking:

Ordering Method and Payment for Services

How Can you Book?

Guaranteed booking – for busy periods and group stays By E-mail, telephone, fax, mail or via the booking form on the Internet. However, a written order is always necessary! On the basis of this order we will make a provisional booking (option) of the requested period and the number of people. This provisional booking will be valid until the expiration of the option (the agreed date), which must be duly confirmed by the client in writing by that date. If the accommodation period is not confirmed by the option expiration, your order – booking will be cancelled.

Ordinary booking – for individual stays. It is possible to book by telephone. However, in busy periods the requested accommodation capacities are reserved only until 6.00 a.m. Then they will be automatically cancelled.

Advance Payments

After confirming the option, the notification for paying the advance invoice will be sent by post. This advance invoice will amount to 50 % of the overall price of services. The due date will always be stated on the advance invoice. We will consider the booking to be binding at the point when the money is credited to our bank account.

Amounts stipulated on advance invoices in Euros are only approximate. The final invoicing is always in CZK.

Bank Accounts

When depositing or transferring advance payments to the account, always put the number of the invoice or possibly your name as the variable symbol. Banking data are always stated on the invoice.

Important notice: all banking fees are always paid by the client!!

Final Invoice

The remaining balance of your invoice will be paid in cash, or a payment card at the Holiday Park. The final invoice will be adjusted for any possible differences (number of persons, days - etc.). From the final invoice, the paid advance will be deducted. Conversion from euros to crowns will always be implemented in compliance with the currently valid exchange rate. Discounts from the price (Gutschein, Club card, ADAC, CCI, etc.) will be deducted during the final payment.

Cancellation Terms and Conditions for Individual Tourists

1. The customer will be entitled to withdraw from the Contract. The withdrawal from the Contract has to be made in writing. Upon the withdrawal from the Contract, the relations between the customer and the accommodation facility will be governed by these conditions:

2. The fee paid for the made reservation will not be returned, because it concerns a mediatory service, which has been implemented.

3. After an agreement with the operator, the client may find a substitute for himself; in this case the cancellation fees will not be paid.

4. If the client cancels the reservation for any reasons, the following cancellation fees will be applied:

Cancellation Periods

If the booking made by the customer is cancelled within the period prior to three weeks before the arrival, the customer will be charged only the handling fee at the amount of CZK 300.00 (10 Euros)

Cancellation Terms and Conditions for Group Stays

Are the subject matter of a mutual agreement. Otherwise, similar conditions apply as for individual tourists.

Cancellation fees are not paid for groups, if the number of booked persons decreases by 10 % at most from the total number of booked persons.

Cancellation of the Stay by the Operator

The operator will be entitled to cancel the stay, if the implementation of the stay has been made more difficult or threatened as a consequence of extraordinary events, which could not have been foreseen at the point of confirming the stay. In this case the operator will offer the client an adequate replacement within his possibilities. Should the customer be unwilling to accept the replacement offer, he will receive the mediation fee back, immediately, without unnecessary delay. Simultaneously, the customer will not be entitled to any other form of compensation.

Insurance of Stays

Lisci Farma Holiday Park does not offer insurance against cancellation in cases of illness – etc. Therefore we recommend arranging this insurance with your insurance company.

The price of the mediated stay does not include insurance. The booked services are used by customers at their own risk. The operator will not be liable for injuries, damage to property (liability for damages to health and property inflicted on third parties) or for theft of luggage for the duration of the stay. We recommend arranging suitable insurance before the accommodation commencement.

General Terms and Conditions

Terms and Conditions for Complaints

Complaints about the service may be asserted by the customer directly to the management. These complaints must be lodged in writing and if possible immediately after discovering the defect, however no later than within three days after the termination of the stay, together with the description of the service under complaint. Other or later complaints will not be taken into consideration!

Final Provisions

1. These general terms and conditions will become effective as from Sep. 1, 2004.

2. By sending the order, the customer confirms that he understands these terms and conditions and fully accepts them.

3. In case of an earlier departure there is no entitlement to get money back.

4. The operator will not be liable for possible discontinuation in the operation of swimming facilities, ski-lifts or restaurants - etc.
